Please read the agreement below carefully before becoming a member of our site.
1. Parties
a) HMYDESIGN DEKORASYON AYDINLATMA TASARIM VE MİMARLIK A.Ş. (Hereinafter referred to as the supplier) located at Tekstilkent Trade Center Oruç Reis Mah.TekstiLkent Cad. A11 Blok No:32 Esenler / Istanbul, which carries out the activities of the www.hmydesign.com website.
b) Internet user who is a member of the www.hmydesign.com website ("Member")
2. Subject of the Agreement
The subject of this Agreement is to determine the conditions under which the member can benefit from the SUPPLIER's website www.hmydesign.com.
3. Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided by him while registering to the www.hmydesign.com website is true before the law, and that he will compensate the SUPPLIER immediately and in full for all damages that may be incurred due to the inaccuracy of this information.
3.2. The Member may not share the password given to it by the SUPPLIER with any other person or organization. The Member has the right to use such password personally. The SUPPLIER reserves the right to claim compensation and other claims arising from such unauthorized use, as well as all liability arising from any claims or demands that may be made against the SUPPLIER by third parties or authorized authorities.
3.3. The Member accepts and undertakes to comply with and not violate the provisions of the legislation when using the www.hmydesign.com website. Otherwise, all legal and criminal liabilities that may arise will be fully and exclusively binding on the Member.
3.4. Members may not use the www.hmydesign.com website in any way that disrupts public order, violates morality, disturbs or harasss others, for any illegal purpose, or infringes on the intellectual property or copyrights of others. Furthermore, members may not engage in any activities or actions that prevent or obstruct others from using the services (spam, viruses, Trojan horses, etc.).
3.5. The opinions and ideas expressed, written, and used by members on the www.hmydesign.com website are solely the members' personal opinions and are solely the responsibility of the opinion holder. These opinions and ideas have no connection or affiliation with the SUPPLIER. The SUPPLIER has no liability for any damages that third parties may suffer as a result of the opinions and ideas expressed by the member, nor for any damages that the member may suffer as a result of the opinions and ideas expressed by third parties.
3.6. The SUPPLIER shall not be liable for any damage to member software and data that may occur due to unauthorized access to member data. The Member agrees in advance not to claim compensation from the SUPPLIER for any damages it may incur due to the use of the www.hmydesign.com website.
3.7. The member agrees not to access or use other internet users' software and data without permission. Otherwise, any legal and criminal liability arising from this will be the sole responsibility of the member.
3.8. Any member who violates one or more of the articles listed in this membership agreement shall be personally and legally liable for such violation and shall hold the SUPPLIER harmless from any legal or criminal consequences arising from such violation. Furthermore, if the incident is brought to court due to such violation, the SUPPLIER reserves the right to claim compensation from the member for non-compliance with the membership agreement.
3.9. The SUPPLIER reserves the right to unilaterally delete a member's membership and delete customer files, documents, and information at any time, if necessary. The Member hereby accepts this disposition in advance. In this case, the SUPPLIER shall have no liability.
3.10. The software and design of the www.hmydesign.com website are the property of the SUPPLIER, and the copyright and/or other intellectual property rights related to them are protected by relevant laws. They cannot be used, acquired, or modified by the member without permission. Other companies and products mentioned on this website are the trademarks of their respective owners and are also protected by intellectual property rights.
3.11. Some information may be collected by the SUPPLIER for the purpose of improving and developing the www.hmydesign.com website and/or within the framework of legal regulations, such as the name of the Internet service provider and Internet Protocol (IP) address used to access the site, the date and time the Site was accessed, the pages accessed while on the site and the Internet address of the website that provides direct connection to the site.
3.12. SUPPLIER may disclose the member's personal information when requested as a legal obligation or when it believes in good faith that it is necessary to (a) act in accordance with legal requirements or comply with legal processes served on SUPPLIER; (b) protect and defend the rights and property of SUPPLIER and www.hmydesign.com website family.
3.13. Measures have been taken to ensure that the www.hmydesign.com website is free of viruses and similar malicious software, within the limits of available resources. Furthermore, to ensure ultimate security, users must provide their own virus protection system and ensure the necessary protection. In this context, by accessing the www.hmydesign.com website, members accept responsibility for all errors that may occur in their software and operating systems, and for any direct or indirect consequences thereof.
3.14. SUPPLIER reserves the right to change the content of the site at any time, to change or terminate any service provided to users or to delete user information and data registered on the www.hmydesign.com website.
3.15. The SUPPLIER may change, update, or cancel the terms of the membership agreement at any time without prior notice and/or warning in any form. Any changed, updated, or repealed provision will be effective for all members on the date of publication.
3.16. The parties accept and declare that all computer records belonging to www.hmydesign.com will be taken as the sole and exclusive evidence in accordance with Article 287 of the Civil Procedure Code and that the said records constitute an evidentiary contract.
3.17. In accordance with this membership agreement, the SUPPLIER has the authority to send information e-mails to its members' registered e-mail addresses and information SMSs to their mobile phones. By approving this membership agreement, the member will be deemed to have accepted the sending of information e-mails to their e-mail addresses and information SMSs to their mobile phones.
4. Termination of the Contract
This agreement will remain in effect until the member cancels their membership or until the SUPPLIER cancels their membership. If the member violates any provision of the membership agreement, the SUPPLIER may unilaterally terminate the agreement by canceling the member's membership.
5. Dispute Resolution
Istanbul Courts and Enforcement Offices have jurisdiction over disputes regarding this contract.
6. Entry into Force
By registering as a member, the member agrees to and has read all of the terms and conditions in the Membership Agreement. This Agreement is concluded and mutually effective upon registration.
